Trial by Algorithm: Who Gets Picked for Life-Saving Drugs?

The call to join a clinical trial once arrived by letter or through a physician’s referral. Today, it is increasingly mediated by algorithms—software that sifts through millions of patient records to identify who qualifies for a potentially life-saving experimental therapy. The promise is speed and efficiency: instead of months of recruitment, a trial might fill in weeks. But hidden within that speed are profound ethical questions. Who gets chosen, who is excluded, and who decides what “fit” really means when the gatekeeper is not a human but a machine?

From Efficiency to Exclusion

Clinical trials are notoriously difficult to recruit for. Fewer than ten percent of eligible patients ever enroll, often because they are never approached. AI-driven matching tools seem like a solution, cross-referencing medical histories, genomic data, and demographic information to identify candidates. Yet efficiency can mask exclusion. If an algorithm overweights certain biomarkers, it may systematically disqualify patients from underrepresented groups, reinforcing disparities that medicine already struggles to overcome.

In one recent case, an oncology trial using an automated screening system excluded a disproportionate number of Black patients because the algorithm relied heavily on kidney function markers known to vary by population. What appeared as neutral computation was, in practice, a continuation of bias.

The Transparency Gap

Patients who are denied entry rarely know why. Traditional clinical decisions can be questioned, appealed, or at least explained by a physician. Algorithmic ones are often black boxes—probabilistic judgments with no clear rationale accessible to patients or even researchers. Transparency in trial design is not just an academic concern: it is a matter of justice. If access to experimental treatment is being decided by opaque rulesets, then fairness demands a right to explanation.

The problem is compounded by commercial incentives. Pharmaceutical companies guard their recruitment models as proprietary assets, shielding them from scrutiny. Patients, meanwhile, are left to wonder whether their exclusion was a matter of science, software, or secrecy.

Between Speed and Humanity

None of this is to dismiss the benefits. Algorithms can spot candidates overlooked by busy physicians, widening the net for rare-disease trials or precision oncology studies. For families who once spent years searching for a match, algorithmic recruitment has brought hope. But the tension remains: in pursuit of efficiency, are we losing sight of medicine’s moral obligation to treat patients as individuals, not datapoints?

One mother I spoke with described the devastation of being told her child did not “qualify” for an experimental therapy because the algorithm flagged a borderline lab value. “I wish I could have argued my case,” she said. “But you can’t argue with a computer.”

Toward Ethical Design

The way forward is not to reject algorithmic tools but to govern them responsibly. Independent auditing of recruitment models, public reporting of selection criteria, and built-in mechanisms for human appeal are all possible. Algorithms should serve as advisors, not arbiters—flagging potential matches while leaving room for clinical judgment and patient voice.

Medicine has always balanced science with ethics. As AI enters the clinic, that balance becomes even more delicate. The future of clinical trials may be faster, but speed should not come at the cost of fairness, dignity, and trust.
